Powell was honored June 28 at a gala event in New York City at the 2010 National Conference on Volunteering and Service, co-convened by Points of Light Institute and the Corporation for National and Community Service.</p>
<p>   Twenty three years ago, Delores Powell moved to the United States from Jamaica with dreams of a better life. Despite working hard as a home health aide, she struggled financially. After moving to Buffalo in 2004, Powell set out to buy a home for her and her four children.</p>
<p>   Unable to afford a realtor or lawyer, Powell negotiated her house purchase without aid, only to discover her new home was on the city&#8217;s demolition list. Though she convinced city officials to give her time, after five and a half years, the family&#8217;s home was still not livable.</p>

<p>   Graafeiland is enjoying his retirement and participating in the pro bono work he never had the chance to do as a corporate lawyer at Eastman Kodak.</p>
<p>   Although Graafeiland, who retired from the company five years ago as chief counsel, did arrange pro bono work for Kodak lawyers and paralegals, he said he never had the time to try it out himself, and often felt a little distant from the local legal scene.</p>
<p>   &#8220;My schedule was too much beyond my control,&#8221; said Graafeiland, who has been active at Volunteer Legal Services Project of Monroe County since his retirement.</p>
<p>   Now he&#8217;s ready to commit to the newly initiated attorney emeritus program announced by New York State Chief Judge Jonathan Lippman in January. A rules change added the new category of lawyer, the status of which is neither active nor retired.</p>
<p>   Attorneys emeritus are free from requiring malpractice insurance, do not have to pay the $350 biennial registration fee and are exempt from CLE requirements.</p>

<p>   Speaking before the Monroe County Bar Association on June 10, Chief Judge Lippman addressed the issue of the poor&#8217;s lack of access to civil legal representation.</p>
<p>   Part of his plan was to initiate the emeritus program and fill it with an untapped resource: &#8220;That is, baby boomers who are coming into retirement age and want to do something meaningful with all the years of expertise they have in the legal profession,&#8221; Chief Judge Lippman said earlier this month, noting that 40 percent of lawyers statewide are close to retirement.</p>
<p>   Joining the program, he said, was akin to a lawyer having a gold star pinned on his or her chest, an sign of the work done in support of indigent clients, with skills learned over a lifetime. He said 50 attorneys already had signed on, and would be assigned to legal services providers, where they&#8217;ll receive an office if needed and training.</p>
<p>   Chief Judge Lippman also noted that the economic downturn has led to an increased number of people showing up in state courts &#8212; estimated at more than 2 million annually &#8212; who cannot afford representation. The sinking economy has manufactured an underfunded and broken legal services system filled with evictions, foreclosure, debt collection and other civil cases, he said.</p>
<p>   Graafeiland has not yet signed on the dotted line, but this week he said the program&#8217;s 60 hours of required service spread out over two years is less pro bono work than he&#8217;s doing now. To qualify for attorney emeritus status, a lawyer must: be 55 years old, be an attorney in good standing, have practiced for at least 10 years and no longer accept paying clients.</p>
<p>   Graafeiland said he was ready and willing. Although he&#8217;s done his share of helping the indigent with pro bono work that &#8220;runs right across the spectrum,&#8221; such as estate planning and living wills for AIDS and cancer patients &#8212; he said <a href="http://www.shoes2toryburch.com/">Tory burch flats</a> he likes the idea of a structured system, and that the program has the chief judge&#8217;s endorsement.</p>
<p>   Graafeiland said he believes there is a &#8220;pronounced need&#8221; for the program and that, once the word is out, its ranks of volunteers will swell.</p>
<p>   &#8220;What&#8217;s nice about the emeritus program is that it does have a certain cachet,&#8221; Graafeiland said. &#8220;As it gains momentum, I think people will flock to the banner.&#8221;</p>

			<content:encoded><![CDATA[<p>   A CLAY company has been fined thousands of pounds after soil escaped from a quarry site near Plymouth and polluted a stream.</p>
<p>  <a href="http://www.women2shoes.com/">Women&#8217;s pumps</a>  Sibelco UK has been ordered to pay Pounds 7,210 in fines and costs after the soil contaminated water in Smallhanger Brook, which runs from Crownhill Down and past Dartmoor National Park.</p>
<p>   The case against the company was brought by the Environment Agency who received numerous reports of discoloured water along the brook on July 7 last year.</p>
<p>   The pollution was traced to an area on Crownhill Down, near Cornwood, where the china clay company, Sibelco UK had stripped grass and topsoil from a large area of moorland to extend quarrying operations.</p>
<p>   Heavy rain caused surface water on the exposed area of land to be contaminated with suspended solids and run-off into the headwaters of the Smallhanger Brook via a temporary drainage channel.</p>
<p>   When the problem was highlighted, Sibelco UK took immediate action and constructed a bund around the site to contain flows <a href="http://www.shoes2toryburch.com/">Tory burch flats</a> but a week after the first reports, more discolouration was found in the water.</p>
<p>   When an officer returned to inspect the site he saw the containment bund had been breached and the stream was once again contaminated with sediment.</p>
<p>   Jon Snowden, for the Environment Agency, said: &#8220;There were no pollution prevention measures in place to try to reduce the environmental impact of potentially harmful run-off from this site.</p>
<p>   &#8220;Anyone undertaking major engineering works must provide adequate containment and settlement facilities to ensure their activities do not pollute nearby watercourses. Sediment entering watercourses blankets the riverbed and clogs the gills of fish and other aquatic life.&#8221;</p>

<p>   Sibelco UK Ltd, of Cheshire was fined Pounds 4,000 and ordered to pay Pounds 3,210 costs at Plymouth Magistrates Court after pleading guilty to two offences of allowing polluting matter to enter the Smallhanger Brook, Drakeland Corner.</p>
<p>   The company told the court the pollution had partly resulted from its efforts to protect certain rare species at the recently cleared site at Crownhill Down.</p>
<p>   It had been told by ecologists and conservationists to avoid disrupting flows of water from the site to protect mosses and other species that thrive in damp conditions.</p>

<p>As outlined in the pesticide management bylaw, residents must submit a formal letter of request to register their property as a buffer zone. When the policy was temporarily waived Thursday, the list skyrocketed from a dozen to 114 registered buffer zones by Saturday night. A doctor&#8217;s note isn&#8217;t required for adulticiding programs; only for annual lawn care type pesticide applications. </p>
<p>Although each buffer zone is 100 metres, or about one city block, Bailey says he&#8217;s confident that the mosquito population has been at least temporarily decimated. </p>

There&#8217;s no doubt the buffers eliminate a real strong control across the board but I don&#8217;t think (the buffer zones) defeated the purpose,&#8221; he said. &#8220;It still allowed us to do the fringe areas and a lot of hot spots across the city, so we&#8217;ve definitely reduced the population.&#8221; </p>
<p>The city is currently on the lookout for additional supplies of malathion so the fringe areas of the city and hot spots like along the riverbank can be targeted one last time &#8212; likely on the weekend, Bailey said. Buffer zone requests will be honoured until the end of this week only. Afterwards, the normal procedure is reinstated. </p>

<p>   But a combination of self-reinforcing events is driving a pernicious reversal of the dynamics of 2008-09. The harsh reality is that much of the debt was not used to finance productive enterprises but fuelled consumption or was channelled into unproductive uses. There are no substantial assets or income from those investments that will help repay the debts.</p>
